Terms of use
These terms apply to your use of the GigKong app and the gigkongapp.com website. By creating an account you agree to them.
1. Platform role
GigKong is a technology marketplace that helps venues discover musicians and bands, view availability and send booking requests. GigKong is not a band representative, talent agent, employer, promoter, payment processor or party to the performance contract between a venue and a musician or band.
2. Direct venue-musician contract
When a booking is accepted, the performance agreement is directly between the venue and the musician or band. The parties are responsible for the date, time, location, performance, fee, cancellation terms and other agreed conditions.
3. Payments
Unless the parties agree otherwise, the agreed performance fee is paid directly by the venue to the musician or band on the day of the show. GigKong does not hold or transfer the performance fee through the app. Each party is responsible for its own tax, invoice, receipt and regulatory obligations.
4. No agency or performance guarantee
GigKong does not represent either party and does not guarantee attendance, payment, performance quality, safety or compliance. GigKong may provide technical support and booking records but does not supervise the performance or decide contractual disputes.
5. Liability
To the maximum extent permitted by law, GigKong is not liable for non-payment, non-performance, cancellation, late arrival, property damage, injury, loss of profit or other losses arising from the venue-musician relationship. Nothing excludes liability that cannot lawfully be excluded.
6. Law and electronic records
These terms are intended to be governed by the laws of North Macedonia. The app records the terms version and acceptance time for evidentiary purposes. This is not represented as a qualified electronic signature; where a formal signature is required, the parties should use an appropriate legally valid method.
7. Eligibility and minimum age
GigKong is not intended for anyone under 16. A venue or musician/band account additionally requires that you are at least 18 and have the legal capacity to enter into the booking contracts the app facilitates. By creating an account you confirm you meet the requirement for your account type.
8. GigKong Access subscription
Browsing venues and artists is free. Sending or accepting booking requests, messaging, and viewing another account's contact details and social links require an active GigKong Access subscription (EUR 9.99 per month, or the local price shown in the store). The subscription is purchased through the Apple App Store or Google Play, is charged to your store account, renews automatically unless cancelled at least 24 hours before the end of the current period, and can be managed or cancelled at any time in your App Store or Google Play subscription settings. Deleting your GigKong account does not cancel the store subscription, so cancel it first. Refunds are handled by Apple or Google under their policies. The subscription fee is for access to GigKong only; it is not a performance fee and no part of the performance fee is paid through GigKong.
9. Content and conduct
You are responsible for the profile, photos and messages you post, and they must be accurate and lawful. Do not post content you have no right to use, harass others, impersonate anyone or misuse the platform. Every profile has Report and Block in the app. We may remove content or close accounts that break these terms.
10. Deleting your account
You can delete your account at any time inside the app. See Delete your account.
11. Changes
Material changes receive a new legal version and may require renewed acceptance before you book or accept bookings.
